1. The Asset Trap & Government Benefits


In New York, obtaining high-cost services such as Self-Direction or in-home care requires qualifying for a Medicaid Waiver via OPWDD.

  • Asset Limits: While the "Front Door" (eligibility) is asset-free, the waiver funding requires the child’s personal assets to be below $33,038 (2026 NY limit). SSI has an even stricter $2,000 limit for adults.

  • The Consequence: A direct inheritance—such as a $500k legacy—will immediately trigger a "benefits cliff," cutting off both medical coverage and professional support services until the funds are exhausted.

2. The Solution: Special Needs Trust (SNT)


An SNT serves as a legal shield. Because the assets are owned by the Trust and not the child, they are excluded from government asset tests. This ensures the child remains eligible for OPWDD funding while the Trust pays for "quality of life" enhancements that state budgets don't cover.

3. Guardianship Beyond 18


Don't forget that in NY, parental rights end at age 18. An Article 17-A Guardianship is essential for parents to continue managing medical, financial, and OPWDD-related decisions for their adult child.
