A Will is a living document—it should reflect your current life. However, how you handle, store, and edit that document in NY or NJ can determine whether the court accepts it or throws it out.

1. Can I Change My Will?


Yes. You can update your Will as long as you have the mental capacity to do so.

  • Codicils: For minor changes (like swapping an Executor), you can use a "Codicil." This is a legal supplement that must be signed and witnessed just like the original Will.

  • Starting Fresh: For major changes, it is usually cleaner to draft a brand-new Will that explicitly revokes all prior versions.

2. Can I Just Cross Out a Name on the Original?


Absolutely not. Handwriting notes or crossing out sections on a signed Will is a recipe for disaster in NY/NJ courts.

  • The Risk: These informal "edits" are usually legally void. Worse, they can create ambiguity that leads to a Will contest.

  • The "Staple" Rule: In New York, Surrogate’s Courts are suspicious of Wills with "staple holes" that suggest the document was disassembled and reassembled. Never remove the staples from your original Will to make copies.

3. What If the Original Will is Lost?


If the original Will cannot be found, the law often presumes that you destroyed it because you intended to revoke it.

  • Are Copies Valid? While a court might accept a copy under extraordinary circumstances (e.g., proving the original was lost in a house fire), it is a very difficult and expensive legal battle.

  • Storage Tip: Keep the original in a safe, fireproof place and ensure your Executor knows exactly where it is.

4. How Do I Properly Revoke a Will?

To ensure an old Will is gone for good:

  • Draft a new Will stating the old one is revoked.

  • Physically destroy the old original (shredding or burning).
