婚前协议:能否要求对方父母承担房屋首付?Can a Prenup Require Parents to Pay the Down Payment?

在日常法律咨询中,我们常常会遇到客户提出一些“脑洞大开”的问题。比如:如果我在婚前协议中写明,男方的父母必须为我们支付房子的首付,这样的条款是否具有法律效力?法院会不会认可?
In our estate and family law practice, we often encounter creative client questions. One common example is: “Can I put into a prenuptial agreement that my fiancé’s parents must pay the down payment for our house? Would such a clause be legally enforceable?”
问题解析
婚前协议(Prenuptial Agreement)的本质,是一份合同。它通常由即将步入婚姻的双方签署:未婚夫与未婚妻。作为合同,它对签署方具有法律约束力。
但是,如果协议中规定了第三方的义务——比如要求男方的父母承担房屋首付——就涉及到一个基本法律问题:合同对未签署的一方通常没有强制力。换句话说,如果男方父母并未在这份协议上签字,法院一般不会强制他们履行该条款。
A prenuptial agreement is, at its core, a contract. Like any contract, it is enforceable only against the parties who sign it. Therefore, if the prenup includes a provision that imposes obligations on a third party—such as requiring the groom’s parents to fund the down payment—this clause will generally not be enforceable in court unless those parents are actual signatories.
解决方案
如果确实希望第三方(如父母)在财产安排中承担责任,正确的做法是:
让第三方直接参与并签署一份单独的合同或赠与协议;
或者在婚前协议之外,父母通过书面协议明确承诺承担特定义务。
If you truly want parents or third parties to have legal obligations, the solution is to:
Have them enter into a separate contract or gift agreement; or
Ensure that they make a written commitment outside of the prenup.
风险提醒
即使写入了父母出资条款,如果父母不同意或没有签字,该条款也可能被法院视为无效。依赖这类条款来保障权益,很可能产生落空的风险。
Even if such clauses are written into the prenup, without the parents’ consent and signature, the provision is at risk of being unenforceable. Relying solely on such terms could create false security.
